Spanish authorities then passed this information to Apple, which was able to identify the individual linked to the account. The recovery email was not encrypted, meaning Proton had to provide it to authorities. Proton's privacy policy confirms that it will only disclose limited user data if legally obligated by a binding request from Swiss authorities, and it may comply with electronically delivered notices only when they meet Swiss legal requirements. The company emphasizes that it cannot decrypt end-to-end encrypted content under any circumstances. Proton's stance is that it provides privacy by default, not anonymity by default, and achieving anonymity requires specific user actions, such as avoiding the use of recovery methods linked to a real identity.

Proton cannot be blamed for obeying the law on neither of these cases. Privacy and anonymity are two very different things. Just like encryption and anonymity, like many VPN providers claim to offer.

it could be that Germany has specific laws separate from the E.U.
Because in Switzerland Laws have be changed or planed to be change. And that in a common Way. I'm not familiar with the Details but it seems to be saving Internet Traffic, IP Adresses and Stuff like that by the State.
