No. Copyright grants the copyright holder (creator or legally contracted distributor) exclusive rights to the creation, sale, and distribution of a creative work.
Downloading something for personal use is no different than copying an LP onto a cassette to use in your own car. You just can't sell or otherwise distribute it.

says who? its called pirating. just because the usa and china breaches law everywhere and will just postpone any lawsuit as long as possible (see GEMA vs youtube lawsuit) it doesnt mean its legal. just pay the artists. this makes me so furious. Anything you create has by default your copyright unless you clearly say it hasnt. any unauthorized copy unless its a backup of something you own/have bought is a copyright infriction in about every country. welcome to this gangstas paradise.

Thank you for demonstrating your lack of understanding of Copyright and Piracy even after reading my post.
Piracy is the distribution of copyright protected material without being granted the right to do so. If you go to a pirate sight and download it, you are participating in piracy.
If the artist or distributor makes the material available free of charge on a public platform like YouTube, that is completely different. As long as you're not re-distributing it it's not piracy nor a violation of copyright.

We shouldn't forget that this is an international Forum. So, many People from many diffrent Countries - which means: Different Rules and Laws.

According to EU Law and to US law, your claim is not actually correct.
By legalities, when you copy an artists work by downloading it, that is considered the act of making an unauthorized copy.

You do not need to sell it nor distribute it in order to violate copyright law - the act of making the copy is simply a sale to yourself for a sum of no money.
@Bandguru is correct about it being, in legal terms, an unauthorized copy.

You cite this above: The Creation of the copy. Which is protected.
That is the legality. A user can also run into Terms of Service or DHCMA infringements.


The next question is: Why is this not a violation of the Forum Guidelines or Terms of Service?

The Forum Guidelines and ToS both cover piracy and illegal copyright infringement as out of bounds.
They do not blanket over that which is not copyright infringement.
In other words: it excludes acts of piracy - not acts that are not piracy, even if in some cases, a person could use it to commit piracy.

Torrent networks can be used in legal ways - and therefor torrents, discussions about torrents, using torrent software are not barred.
But a topic that promotes using torrents for piracy, will be shut down.
Downloading content that is legal is allowed, like videos, but topics that seek to download Netflix is piracy and gets shut down.

And... Downloading your favorite podcast and converting to .mp3 to listen to it in the car in traffic is legal and fine a lot of the time... but if a thread is opened asking for help in piracy or illegal use of these tools - it will be shut down.
